1. Acceptance of These Terms

These Terms & Conditions (“Terms”) govern your access to and use of Turf Cleaning Academy, including TurfCleaningAcademy.com, academy.dirtyturf.com, the Turf Cleaning Academy mobile application, courses, community groups, live events, digital content, certification programs, and related features and services (collectively, the “Academy”).

The Academy is operated by Dirty Turf, LLC (“Dirty Turf,” “Turf Cleaning Academy,” “we,” “us,” or “our”). By creating an account, purchasing or accessing a course, joining the Academy community, downloading or using the mobile application, or otherwise using the Academy, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Academy.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to create an Academy account or purchase Academy products or services.

If you access the Academy on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms. You agree to provide accurate, current, and complete information when creating or maintaining your account.

3. Academy Accounts

Certain Academy features require an account. You are responsible for maintaining the confidentiality of your login credentials, all activity occurring through your account, providing accurate account information, and promptly notifying us if you believe your account has been compromised.

Accounts and course access are personal to the registered user unless we expressly authorize business, team, or technician access. You may not sell, transfer, share, sublicense, or otherwise provide your account credentials or paid Academy access to another person.

We may suspend or restrict access if we reasonably believe an account is being shared, misused, compromised, or used in violation of these Terms.

4. Courses and Educational Content

Turf Cleaning Academy provides educational content relating to professional artificial turf cleaning, equipment, chemistry, operations, marketing, sales, business management, technician training, and related topics.

Course offerings, lessons, instructors, features, schedules, downloadable resources, community access, and other Academy materials may change over time as we improve or update the Academy.

Unless otherwise stated at the time of purchase, purchasing a course grants you a limited, personal, non-exclusive, non-transferable license to access the applicable course materials for your own educational and professional development. Purchasing or completing a course does not transfer ownership of Academy content or intellectual property to you.

5. Certification

Certain Academy programs may offer a certificate or designation upon completion of specified coursework or requirements. Academy certification represents completion of our educational requirements. It does not constitute a government-issued license, state or federal accreditation, a trade license, a guarantee of employment, or a guarantee of business success, income, competency in every field condition, or regulatory compliance.

You remain responsible for complying with laws, regulations, licensing requirements, chemical labels, equipment manufacturer instructions, workplace safety requirements, and other rules applicable to your own business or employment. We may establish, modify, or update certification requirements as the Academy evolves.

6. Purchases, Payments and Refunds

Prices and payment terms will be disclosed before purchase. Payments may be processed by third-party payment processors, and we generally do not directly store complete payment-card information. You are responsible for applicable taxes, fees, and charges disclosed at checkout.

Any applicable refund or cancellation terms will be disclosed at checkout, in purchase-specific terms, or through the marketplace through which the purchase was completed. Purchases made through Apple, Google, or another third-party marketplace may also be subject to that marketplace’s payment, subscription, cancellation, and refund rules.

If a recurring membership or subscription is offered, cancellation stops future renewal charges according to the terms presented at purchase but does not necessarily delete your Academy account. Failure to pay amounts when due may result in suspension or termination of access to paid Academy content.

7. Community Participation

The Academy includes private community features that may allow members to create posts, comment, upload images or other materials, participate in discussions, interact with other members, attend events, and communicate through available platform features.

Our goal is to maintain a professional community where turf cleaning business owners, technicians, and industry participants can learn from one another. When participating in the community, you agree to interact respectfully and professionally.

You may not post, transmit, upload, or otherwise make available content that:

  • Is unlawful, fraudulent, threatening, abusive, harassing, defamatory, discriminatory, hateful, obscene, sexually explicit, or otherwise objectionable.
  • Promotes violence, illegal activity, dangerous conduct, or intentional misuse of chemicals or equipment.
  • Harasses, bullies, intimidates, impersonates, or targets another person.
  • Infringes copyrights, trademarks, privacy rights, publicity rights, trade secrets, or other rights of another person.
  • Contains malware, malicious code, phishing attempts, scams, or deceptive links.
  • Includes another person’s private or confidential information without authorization.
  • Consists primarily of unsolicited advertising, repetitive promotion, spam, or unauthorized solicitation.
  • Attempts to interfere with the Academy, its members, or its technology.
  • Violates these Terms, applicable law, or applicable Apple or Google platform policies.

8. Community Moderation, Reporting and Blocking

We may review, moderate, restrict, remove, or refuse content or participation that we believe violates these Terms, community standards, applicable law, or the safety of the Academy community.

Members may be able to report content or other members through tools provided within the Academy or mobile application. Where supported by the platform, members may also block or restrict interactions with other users.

We may investigate reports and take actions including removing content, issuing warnings, limiting posting or messaging privileges, temporarily suspending an account, or permanently removing a member from the community or Academy. Repeated or serious violations may result in immediate termination.

If you encounter objectionable content or behavior that requires our attention, you may also contact us using the information at the end of these Terms.

9. Your Content

“Your Content” means posts, comments, photographs, videos, files, messages, feedback, and other materials you submit to the Academy. You retain ownership of Your Content.

By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, and otherwise use it as reasonably necessary to operate, moderate, provide, secure, and improve the Academy. This license does not transfer ownership of Your Content to us.

You represent that you own or have the necessary rights to anything you submit and that Your Content does not violate the rights of another person. We may remove Your Content if reasonably necessary to enforce these Terms or comply with legal or platform requirements.

10. Academy Intellectual Property

Except for Your Content and third-party materials, all Academy content and materials are owned by or licensed to Dirty Turf, LLC. This includes course videos, lessons, training materials, documents, checklists, processes, graphics, photography, branding, logos, certification materials, community resources created by us, website and app designs, text, audio, software, and other digital content.

You may use these materials only for your own authorized Academy participation. Without our written permission, you may not:

  • Copy or redistribute Academy materials.
  • Record or reproduce course content.
  • Share course login credentials.
  • Upload Academy materials to another website, platform, course, or AI training dataset.
  • Sell, license, sublicense, or commercialize Academy content.
  • Create substantially derivative training programs from Academy materials.
  • Publicly display paid Academy content.
  • Circumvent access controls.
  • Scrape, harvest, systematically download, or extract Academy data or content.

11. Acceptable Use

You may not use the Academy for unlawful purposes; to interfere with or disrupt the Academy or other users; to attempt unauthorized access to accounts, systems, or data; to distribute malicious software; to impersonate another person or misrepresent your affiliation; to collect information about other members for unauthorized commercial purposes; or to operate bots, automated scraping tools, or similar automated systems without our written consent.

You may not reverse engineer or exploit the Academy or application except where expressly permitted by law.

12. Mobile Application

The Turf Cleaning Academy mobile application provides mobile access to Academy features such as courses, community content, notifications, account features, and other functionality.

You are responsible for having a compatible device, internet connection, and any carrier or data charges associated with using the app. App features may request device permissions such as notifications, camera, microphone, or photo-library access. You control these permissions through your device settings.

We may issue updates to maintain security, compatibility, performance, or functionality. Some updates may be required for continued use. Use of the application may also be subject to applicable Apple App Store or Google Play terms.

13. Notifications and Communications

You may receive account, course, community, security, transactional, or other service-related communications. If you enable push notifications, the Academy may send notifications relating to community activity, course content, announcements, events, or other Academy features. You can manage push-notification permissions through your device settings.

Marketing email or SMS communications will be sent subject to applicable consent requirements. You may unsubscribe from marketing communications using the unsubscribe mechanism provided. Certain operational communications necessary to administer your account may continue even if you opt out of marketing.

14. Educational and Business Disclaimer

Academy content is provided for educational and informational purposes. The Academy does not guarantee that you will start a successful turf cleaning business, generate any particular amount of revenue or profit, obtain customers or leads, achieve any specific financial result, successfully resolve every turf condition, or qualify for employment, licensing, insurance, or other professional requirements.

Business performance varies based on individual effort, market conditions, experience, competition, pricing, execution, and other factors. Nothing in the Academy constitutes individualized legal, accounting, tax, financial, insurance, occupational-safety, medical, or regulatory advice.

15. Safety and Professional Responsibility

Artificial turf cleaning can involve machinery, chemicals, electrical equipment, pressure systems, vehicles, outdoor working conditions, and other risks. Academy materials do not replace manufacturer instructions, Safety Data Sheets, chemical labels, required personal protective equipment, OSHA or other workplace requirements, local laws and regulations, or professional judgment.

You are responsible for safely applying what you learn and determining whether a process, chemical, product, or piece of equipment is appropriate for a particular situation.

16. Third-Party Platforms and Services

The Academy uses third-party technology and service providers to operate various features. This may include HighLevel/LeadConnector for client portal, course, community, application, account, communication, or related functionality, as well as payment processors, analytics providers, video hosts, email providers, push-notification services, cloud infrastructure, and other vendors.

Third-party services may have their own terms and privacy policies. We are not responsible for third-party services outside our reasonable control.

17. Leaving the Community

Members may be able to leave an Academy community through available account or community controls. Leaving a community may immediately revoke access to associated community resources, courses, events, or paid content depending on how your access was provided.

Leaving a community is not necessarily the same as canceling a paid subscription or deleting your Academy account.

18. Account Deletion

You may request deletion of your Academy account using the account-deletion options available within the mobile application or by using our external account-deletion page:

Upon a valid deletion request, we will delete or de-identify personal information associated with your account except information we are permitted or required to retain for legitimate purposes such as legal compliance, fraud prevention, financial recordkeeping, dispute resolution, or enforcement of our agreements.

Deleting an Academy account may permanently remove access to courses, progress records, certificates, community content, membership benefits, and other associated resources. Deletion is different from merely leaving a community or canceling a paid subscription.

19. Suspension and Termination

We may suspend or terminate access if you violate these Terms or community standards; infringe intellectual property; engage in fraud, abuse, harassment, or unlawful conduct; share or resell unauthorized access; fail to make required payments; or create material security or safety concerns.

Where appropriate, we may provide notice or an opportunity to correct a violation, but serious misconduct may result in immediate termination.

20. Availability and Changes

We may modify, improve, discontinue, replace, or update Academy features, content, courses, community functions, instructors, software, or availability. We do not guarantee uninterrupted or error-free availability.

Reasonable downtime may occur due to maintenance, third-party platform availability, technical issues, updates, or circumstances outside our control.

21. Disclaimer of Warranties

To the fullest extent permitted by law, the Academy is provided on an “as is” and “as available” basis. We disclaim warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, except where such warranties cannot legally be disclaimed.

22. Limitation of Liability

To the fullest extent permitted by law, Dirty Turf, LLC and its owners, officers, employees, contractors, instructors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Academy. This includes lost profits, lost business opportunities, lost data, business interruption, or reliance on Academy materials.

Nothing in these Terms excludes liability that cannot legally be limited or excluded.

23. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Dirty Turf, LLC and its owners, officers, employees, contractors, instructors, and affiliates from claims, damages, losses, liabilities, and expenses arising from your violation of these Terms, your misuse of the Academy, Your Content, your infringement of another person’s rights, or your business practices or application of Academy training.

24. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Unless applicable law requires otherwise, disputes arising from these Terms or the Academy will be subject to the jurisdiction of the appropriate state or federal courts located in Maricopa County, Arizona.

25. Changes to These Terms

We may update these Terms as the Academy, application, legal requirements, or our business practices evolve. The Effective Date above identifies the latest revision.

If a change materially affects your rights, we may provide additional notice where required. Continued use of the Academy after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

26. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

27. Entire Agreement

These Terms, together with the Privacy Policy and any purchase-specific terms presented to you, constitute the agreement governing your use of the Academy.
